परायी स्त्री से सम्भोग करने पर सजा -
परदाराभिमर्शेषु प्रवृत्तान्नॄन्महीपतिः।
उद्वेजनकरैर्दण्डैश्छिन्नयित्वा प्रवासयेत्॥
परस्त्रियं योऽभिवदेत्तीर्थेऽरण्ये वनेऽपि वा।
नदीनां वाऽपि संभेदे स संग्रहणमाप्नुयात्॥
- (मनुस्मृति - 8 : 352)
अर्थ -पराई स्त्री के साथ सम्भोग करने वाले मनुष्यों को राजा पीड़ा देने वाले दण्डों से नाक-कान आदि कटवाकर देश से निकल दे।
The king should expel a person from the country who make illicit relations with the wife of others, married woman, after giving him painful punishments and cutting off his nose and ears.
This rule is equally applicable to married woman as well, who enter into sexual alliance with others of their own or lure them.
परस्त्रियं योऽभिवदेत्तीर्थेऽरण्ये वनेऽपि वा।
नदीनां वाऽपि संभेदे स संग्रहणमाप्नुयात्॥
(मनुस्मृति -8:356)
अर्थ -जो पुरुष पराई स्त्री से तीर्थ में या नदी के पास, जंगल में या गाँव के बाहर निर्जन उपवन में या नदियॉं के संगम स्थान में रहस्य भाषण करे तो उसे राजा संग्रहण (एक सहस्त्र-हजार पण) का दण्ड दे।
One is liable to be fined with one thousands Pan, if he seduce-entice, lure, motivate or coerce other’s wife at a pilgrimage, near the river, junction of rivers, in the forest-jungles, out side the village etc. for adultery.
अर्थ -जो पुरुष पराई स्त्री से तीर्थ में या नदी के पास, जंगल में या गाँव के बाहर निर्जन उपवन में या नदियॉं के संगम स्थान में रहस्य भाषण करे तो उसे राजा संग्रहण (एक सहस्त्र-हजार पण) का दण्ड दे।

बलात्कार करने पर सजा -
सकामां दूषयंस्तुल्यो न वधं प्राप्नुयान्नरः॥
(मनुस्मृति - 8 : 364)
अर्थ -जो मनुष्य किसी कन्या के साथ बलात्कार करके उसे दूषित करता है, वह तत्काल वध करने योग्य होता है। पर कन्या की इच्छा से उसे दूषित किया गया हो, तो वह वध के योग्य नहीं होता।
The man who rapes a girl deserves murder on the spot. But if the intercourse has taken place due to the consent-desire of the girl and the girl , he may not be killed.
संवत्सराभिशस्तस्य दुष्टस्य द्विगुणो दमः।
व्रात्यया सह संवासे चाण्डाल्या तावदेव तु॥
अर्थ -जो मनुष्य किसी कन्या के साथ बलात्कार करके उसे दूषित करता है, वह तत्काल वध करने योग्य होता है। पर कन्या की इच्छा से उसे दूषित किया गया हो, तो वह वध के योग्य नहीं होता।

दूसरे के स्त्री के साथ अवैध सम्बन्ध रखने पर सजा-

अर्थ -परस्त्री गमन से दूषित पुरुष दण्डित होने पर यदि एक वर्ष बाद फिर वैसा अपराध करे तो उसे पहले से दुगुना दण्ड देना चाहिये। दुष्ट स्त्री और चाण्डालिनी के पास जाने वाले के लिये भी राजा इसी दण्ड की व्यवस्था करे।
The king should impose double the fine if a person is found involved in sex with the wife of someone else again after one year. Anyone who visits the cruel or untouchable (Chandalini, Nat, Kanjar or Dom woman) for sex has to be treated likewise.
अर्थ -परस्त्री गमन से दूषित पुरुष दण्डित होने पर यदि एक वर्ष बाद फिर वैसा अपराध करे तो उसे पहले से दुगुना दण्ड देना चाहिये। दुष्ट स्त्री और चाण्डालिनी के पास जाने वाले के लिये भी राजा इसी दण्ड की व्यवस्था करे।

वेद इस विषय में क्या कहते है
उत्सक्थ्या अवगुदं धेहि समंजिं चारया विशन्। य: स्त्रीणां जीवभोजन:॥
- (यजुर्वेद 23 : 21)
अर्थ -हे शक्तिमान राजन् (विशन्) जो पापी लोग स्त्रियों के साथ व्यभिचार एवं बलात्कार करके उनका जीवन नष्ट करने वाले हैं उन्हें पैर ऊपर और सिर नीचे करके उल्टा लटका कर मारना करना चाहिये और इस प्रकार अपने राष्ट्र में न्याय का संचार करना चाहिये।
Its utmost duty of the King or Ruler to punish those Sinners (Rapists) who destroys the life of a women by Illicit conduct or Rape by hanging them upside down and by beating them so that Morality, Peace and Justice prevail in his kingdom – Yajur Veda 23:21
